Terms of Service

1. Acceptance of Terms

By accessing or using PostNGo Pro ("PostNGo," "we," "us," or "our") at postngo.co or any associated mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our service.

These Terms apply to all users, including free and paid subscribers.

2. Description of Service

PostNGo Pro is a social media content creation platform that provides:

• AI-powered caption generation ("PostNGo Captions")
• Branded post design tools and templates
• Content calendar and weekly planning tools
• Carousel creator and A/B variant testing
• Multi-platform content export

The service is provided as a web application accessible at postngo.co and as a Progressive Web App (PWA) installable on mobile devices.

3. Accounts and Registration

3.1 Account Creation

To use PostNGo, you must create an account through our authentication provider, Clerk. You may register using an email address, Google account, or Apple ID.

3.2 Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] if you suspect unauthorized access to your account.

3.3 Eligibility

You must be at least 13 years of age to use PostNGo. By creating an account, you represent that you meet this requirement. If you are under 18, you represent that you have parental or guardian consent.

3.4 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

4. Subscription Plans and Billing

4.1 Free Plan

PostNGo offers a free plan with limited features including a set number of posts per month and AI caption generations. Free plan limitations are displayed in the app and on our pricing page.

4.2 Pro Plan

The Pro plan is available for $9 per month (or $79 per year as displayed at time of purchase). Pro subscribers receive unlimited posts, unlimited AI caption generations, all premium templates, and additional features as described on our pricing page.

4.3 Billing

All payments are processed securely through Stripe. By subscribing to the Pro plan, you authorize PostNGo to charge your payment method on a recurring basis at the applicable subscription rate.

4.4 Free Trial

If a free trial is offered, it will be clearly communicated at the time of sign-up. At the end of the trial period, your subscription will automatically convert to a paid subscription unless you cancel before the trial ends.

4.5 Price Changes

We reserve the right to change subscription prices. We will provide at least 30 days advance notice of any price changes via email to your registered address.

4.6 Taxes

Prices displayed may not include applicable taxes. You are responsible for any taxes applicable to your subscription.

5. Cancellation and Refunds

5.1 Cancellation

You may cancel your Pro subscription at any time through your account settings or by contacting us at [email protected]. Cancellation takes effect at the end of your current billing period. You will retain access to Pro features until the end of the paid period.

5.2 Refunds

We offer refunds within 7 days of initial purchase or renewal if you have not used the service during that period. To request a refund, contact [email protected] with your account email and reason for the refund request. Refunds are issued to the original payment method and may take 5-10 business days to process.

5.3 No Partial Refunds

We do not provide partial refunds for unused portions of a subscription period beyond the 7-day refund window.

6. AI-Generated Content

6.1 PostNGo Captions

PostNGo uses artificial intelligence, including the Anthropic Claude API, to generate captions, hooks, hashtags, and other content ("AI-Generated Content").

6.2 Content Ownership

You own the content you create using PostNGo, including AI-Generated Content that you generate, edit, and export through our platform. PostNGo does not claim ownership of your content.

6.3 Content Accuracy

AI-Generated Content is provided for your convenience and creative use. PostNGo does not guarantee the accuracy, originality, or suitability of AI-Generated Content for any particular purpose. You are solely responsible for reviewing, editing, and determining the appropriateness of any content before publishing it.

6.4 No Copyright Guarantee

We do not guarantee that AI-Generated Content is free from third-party intellectual property claims. You are responsible for ensuring your use of AI-Generated Content complies with applicable laws.

7. User Content and Conduct

7.1 Your Content

You retain ownership of any logos, images, brand assets, and other content you upload to PostNGo ("User Content"). By uploading User Content, you grant PostNGo a limited license to process and display your content solely for the purpose of providing the service to you.

7.2 Acceptable Use

You agree not to use PostNGo to:

• Create or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or discriminatory
• Infringe on any third-party intellectual property rights
• Distribute spam, malware, or harmful code
• Attempt to gain unauthorized access to our systems
• Violate any applicable local, state, national, or international law
• Create content that impersonates any person or organization

7.3 Content Removal

We reserve the right to remove any content that violates these Terms or that we deem harmful, at our sole discretion.

8. Intellectual Property

8.1 PostNGo Property

PostNGo Pro, including its design, templates, software, trademarks, and content (excluding User Content and AI-Generated Content you create), is owned by PostNGo and protected by applicable intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to use PostNGo for your personal or business content creation purposes in accordance with these Terms.

8.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of our service or software, nor may you reverse engineer or attempt to extract the source code of our software.

9. Third-Party Services

PostNGo integrates with the following third-party services:

• Clerk — User authentication and account management (clerk.com)
• Stripe — Payment processing (stripe.com)
• Anthropic — AI caption generation via Claude API (anthropic.com)
• TiDB — Database storage
• Amazon S3 — File and image storage

Your use of PostNGo is also subject to the terms of service and privacy policies of these third-party providers. PostNGo is not responsible for the practices of these third-party services.

10. Disclaimers and Limitation of Liability

10.1 Service Provided "As Is"

PostNGo is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

10.2 Service Availability

We do not guarantee that PostNGo will be available at all times or free from errors. We may suspend or discontinue the service at any time with reasonable notice.

10.3 Limitation of Liability

To the fullest extent permitted by law, PostNGo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of revenue, or loss of business opportunities.

10.4 Maximum Liability

Our total liability to you for any claims arising from these Terms or your use of PostNGo shall not exceed the amount you paid to PostNGo in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold PostNGo and its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your User Content, or your violation of these Terms.

12. Termination

12.1 Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through the account settings.

12.2 Termination by PostNGo

We may suspend or terminate your account at any time if we believe you have violated these Terms, engaged in fraudulent activity, or if required by law. We will provide notice where reasonably possible.

12.3 Effect of Termination

Upon termination, your right to use PostNGo ceases immediately. We may delete your account data in accordance with our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of PostNGo shall first be attempted to be resolved informally by contacting us at [email protected]. If informal resolution fails, disputes shall be resolved through binding arbitration in Maryland, except that either party may seek injunctive relief in a court of competent jurisdiction.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or by posting a notice in the app at least 14 days before the changes take effect. Your continued use of PostNGo after the effective date constitutes acceptance of the updated Terms.
